Penalties for a Felony DUI in Kent County

In Rhode Island, felony DUI is covered under Section 31-27-2 (3), which states that any 3rd or subsequent DUI offense within a 5 year period is a felony offense, punishable by:

  • Felony conviction
  • A $400 fine (up to .08% BAC)
  • Fine ranging between $1,000 and $5,000 with a BAC of .15% or above
  • Between 1 and 3 years in prison (up to .08% BAC)
  • From 3 to 5 years in prison (Above .15% BAC)
  • A 2 to 3 year driver's license suspension
  • A 3 year license suspension for .15% BAC and above
  • Highway assessment of $500
  • Ignition interlock device requirement (IID)
  • Attend alcohol or drug treatment program

In addition to the above, anyone who is convicted of a third violation of driving under the influence of drugs or any controlled substance, or a combination thereof is subject to having their vehicle seized and sold by the state of Rhode Island. In this case, all funds acquired through the sale of the vehicle will be transferred to the general fund.
